If the tenants violate a rule under HOA Covenants, Conditions, and Restrictions (CC&Rs), or if the HOA is not fond of renters, the tenants and the HOA may eventually have a dispute. Even if your tenants are the ones actually living in the HOA community, you as the landlord technically still have the responsibility to ensure that HOA rules are followed and dues are paid. If your tenants continuously fail to follow the rules, you will be the one who is fined. At worst, you will be the person against whom the HOA could take legal action if the problem is not corrected.

Therefore, it is wise to formulate a clear communication method among yourself, the tenants and the HOA to deal with major problems before they lead to fines, evictions, or legal action. Furthermore, it’s always a good idea to include HOA rules in your lease agreement. You will also want to carefully screen your prospective tenants and try to select those who seem more likely to follow the rules of the community.
